Return and Refund Policy

yourCA is a professional services organisation providing accounting, tax, company secretarial, financial reporting, payroll, advisory and related professional services. The services offered through our website are services and not physical goods. Accordingly, returns are not applicable.

1. Professional Services

When you purchase a service from yourCA, you are purchasing professional time, expertise, administrative processing and/or the preparation and submission of work on your behalf.

Once an order has been accepted and yourCA has commenced work on the service, fees paid are non-refundable, subject to any rights that may not lawfully be excluded under applicable South African legislation.

Work will be regarded as having commenced when yourCA has taken any step in performing the service, including, without limitation:

  • reviewing information or documentation supplied by you;
  • opening or allocating the engagement internally;
  • performing calculations, reconciliations, registrations or reviews;
  • preparing documents, returns, resolutions, certificates or submissions;
  • communicating with SARS, CIPC or another regulatory or governmental authority on your behalf; or
  • incurring costs or allocating professional time in connection with your instruction.

2. Consent to Commence Services

By placing an order through our website and providing the information, documents or instructions required for us to perform the service, you expressly request and consent to yourCA commencing performance of the service immediately, including before the expiry of any statutory cooling-off period that may otherwise apply to an electronic transaction.

3. Change of Mind

A refund will not be provided merely because you:

  • change your mind after the service has commenced;
  • no longer require the service;
  • fail to provide the information or documentation required for completion of the service;
  • provide incorrect or incomplete information;
  • fail to respond to requests for information;
  • subsequently decide to use another accountant, tax practitioner or service provider; or
  • experience delays resulting from SARS, CIPC, a bank, regulatory authority or another third party outside the reasonable control of yourCA.

4. Cancellation Before Work Commences

If you wish to cancel a service before yourCA has commenced any work, you must contact us as soon as possible.

Where no work has commenced and no costs have been incurred, yourCA may cancel the instruction and refund the amount paid, where required by applicable law or otherwise agreed by yourCA.

Where professional time has already been spent or costs have been incurred, yourCA reserves the right to deduct or retain a reasonable amount in respect of the work performed and costs incurred, to the extent permitted by law.

5. Government and Third-Party Fees

Any amount already paid or committed to CIPC, SARS, banks, software providers, regulatory authorities or other third parties is non-refundable by yourCA once the relevant payment or commitment has been made.

Where a third-party fee is refundable by the relevant third party, any refund will be subject to that third party's own rules and procedures.

6. Completed Services

Once a service has been completed or the agreed deliverable has been prepared, issued, filed or submitted, the service is regarded as rendered and no refund will be provided merely because the client no longer requires or wishes to use the completed service.

Professional services do not guarantee a particular outcome or decision by SARS, CIPC or any other regulatory authority unless expressly stated otherwise in writing.

7. Errors or Deficiencies in Services

If you believe that a service has not been performed in accordance with the agreed scope, please notify yourCA promptly and provide sufficient information for us to investigate the matter.

Where appropriate, yourCA will first be afforded a reasonable opportunity to correct or remedy the service.

Nothing in this Policy is intended to exclude, restrict or limit any right or remedy that a consumer may have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African law, where such right or remedy cannot lawfully be excluded.

8. Duplicate or Incorrect Payments

If you have accidentally made a duplicate payment, or an incorrect amount has been charged due to an administrative or payment-processing error, please contact us. Once verified, any amount incorrectly received will be refunded or credited, as appropriate.

9. Engagement-Specific Terms

Certain services, monthly packages, retainers or ongoing engagements may be subject to separate engagement letters, proposals or service agreements containing specific cancellation and payment provisions.

Where applicable, those terms must be read together with this Policy. In the event of a conflict, the engagement-specific terms will apply to the extent permitted by law.
